    I bought my five-year-old Range Rover Evoque, 2 years ago from a private seller. It had no warranty left. Regularly serviced. It has only done 22,000 miles. Last week the started slowing down, I pulled over and stopped. The car will not go into any gear. Had to be towed into JLR garage.

    After writing to CEO at JLR they agreed to pay 40% of £9,800 costs. My questions is as the car has only done 22,000 miles and the gearbox has packed up should the manufacturer, JLR, be made to pay to replace the gearbox?

    Can it not be argued that gearbox was not fit for purpose? The garage said the gearbox had swarf in the gearbox. As I did not buy it from garage and had no warranty I cannot go after the garage. Can you advise please?

    You are entitled to get a second opinion from a transmission specialist as to whether the gearbox failure can be blamed on the gearbox itself being faulty as opposed to having been damaged by you (or the previous owner).
