I signed an order for a Ford Focus ST through a broker and paid a £500 deposit.
The broker tells me they had an agreement to supply this model from the dealer at the discounted rate.
The dealer has now contacted the broker to tell them that even though the ST model was on the agreement with the broker it was actually a mistake and shouldn’t have been on there.
The broker has refunded my £500 deposit.
Are they not obliged to sell me the car at the agreed price as I have a signed order form?
Isn’t this abreachh of contract?
Hi Skip. Unfortunately, going via a broker tends to complicate matters and your rights may be very different.
If you have a signed order form from a dealer, with you as the buyer, then you may have grounds to take legal action against the dealer. If you have an order form from the broker, there’s probably very little you can do as the broker doesn’t supply the vehicle.
